Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Label Guard mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Label Guard ("we," "us," or "our").

2. Description of Service

Label Guard is a mobile application that helps users identify allergens and dietary restrictions in food ingredient lists through optical character recognition (OCR) and artificial intelligence analysis.

The App processes all data locally on your device and does not require an internet connection for core functionality.

3. Eligibility

To use the App, you must be at least 13 years old. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your mobile device
• Use the App for personal, non-commercial purposes
• Access and use the features provided by the App

This license does not allow you to:

• Modify, reverse engineer, or create derivative works of the App
• Distribute, sell, or transfer the App to third parties
• Use the App for any unlawful or unauthorized purpose

5. User Conduct

You agree to use the App responsibly and in compliance with applicable laws. You shall not:

• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to our systems
• Use the App to transmit harmful or malicious content
• Violate any third-party rights, including intellectual property rights
• Engage in any activity that could harm or discredit us

6. Intellectual Property

The App and all related content, features, and functionality are owned by Label Guard and are protected by copyright, trademark, and other intellectual property laws.

All trademarks, service marks, and trade names used in connection with the App are trademarks of Label Guard.

You acknowledge that you do not acquire any ownership rights by using the App.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

8. Disclaimers

8.1 Medical and Health Information

The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

The information provided by the App is for informational purposes only and should not be used as a substitute for professional medical advice.

8.2 Accuracy of Information

While we strive to provide accurate and up-to-date information, we make no representations or warranties about the accuracy, completeness, or reliability of the App's analysis or any information provided.

8.3 General Disclaimer

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Label Guard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the App
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from our servers
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our App
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

In no event shall Label Guard's total liability to you for all damages exceed the amount paid by you, if any, for accessing or using the App.

10. Indemnification

You agree to defend, indemnify, and hold harmless Label Guard and its officers, directors, employees, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any claim that your use of the App caused damage to a third party

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the App will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall be resolved exclusively in the courts of British Columbia, Canada.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and Label Guard regarding the use of the App and supersede all prior and contemporaneous agreements, understandings, or representations.
